1. Acceptance and eligibility

By using this website, submitting an inquiry, or arranging a service with Lake & Canyon Expeditions Co. (“we,” “us,” or “our”), you agree to these Terms & Conditions. If you do not agree, do not use the website. You must have the legal capacity to enter into an agreement and must provide accurate, current information.

2. Inquiries are not reservations

The website itinerary builder and email links create requests for information only. A tour is not reserved until we confirm availability and you complete every required booking step, which may include accepting booking terms, signing participant documents, and making payment. Displayed departure windows, routes, inclusions, and availability are not guaranteed.

3. Rates, payment, cancellation, and changes

Current rates, taxes, fees, payment timing, minimum guest requirements, refund eligibility, cancellation deadlines, rescheduling rules, and no-show terms will be disclosed during booking and incorporated into your reservation. Those booking-specific terms control if they conflict with general website descriptions.

We may delay, reroute, modify, reschedule, or cancel an activity when weather, wind, water, traffic, access, equipment, staffing, government action, emergency, or other field conditions make that decision appropriate. Any operator cancellation remedy will be governed by the confirmed booking terms.

4. The river is dynamic

Distances, timing, water color, cave illumination, temperatures, wildlife, scenery, and route descriptions are estimates or representative depictions. Emerald reflections and wildlife sightings are never guaranteed. Guides retain final authority over launch, route, pace, stopping points, equipment use, and whether a guest may continue when safety or group welfare is involved.

5. Guest responsibilities

• Follow guide instructions, park rules, launch requirements, and all safety briefings.
• Wear a properly fitted U.S. Coast Guard-approved personal flotation device while underway.
• Disclose relevant medical, mobility, swimming, accessibility, or equipment fit concerns before departure.
• Arrive on time, remain with the group, care for issued equipment, and behave respectfully toward people, wildlife, and the environment.
• Do not participate while impaired or bring prohibited items.

Age, weight, ability, equipment fit, supervision, and other participation requirements may apply and will be confirmed before booking.

6. Outdoor risk and participant documents

Kayaking, transportation, hiking, swimming, shoreline access, heat exposure, and outdoor recreation involve inherent and other risks, including changing weather and water conditions, currents, wind, heat, cold, sun, wildlife, falling rock, vessel traffic, equipment failure, slips, falls, collisions, illness, injury, and delayed emergency response. Before participating, each eligible guest may be required to sign a separate acknowledgment of risk, release, waiver, medical disclosure, and photo-election form. These website terms do not replace those documents.

7. Pickup and transportation

Mandalay Bay’s Beach Level is a designated pickup coordination point, but exact meeting instructions and pickup eligibility must be confirmed. Times are pickup windows or preferences unless expressly confirmed. Guests are responsible for being at the confirmed location on time and for verifying any parking, rideshare, hotel, or self-drive arrangements.

8. Website content and third-party services

Text, design, graphics, video, photography, maps, and other original site materials are owned by or licensed to us and may not be copied, republished, or commercially exploited without permission. Information from government sources and third-party materials remain subject to the respective owners’ rights and terms.

Weather feeds, map sources, email, booking tools, payment services, and external links are provided by third parties. We do not control and are not responsible for their availability, accuracy, security, content, or practices.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, the website and its informational content are provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or noninfringement. The website’s map and weather information are planning aids only and are not navigation, emergency, or safety instructions.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use. Nothing in these terms excludes liability that cannot lawfully be limited, and separate booking or participant agreements may contain additional lawful provisions.

10. Governing law and changes

These website terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction unless a confirmed booking agreement specifies another lawful process. We may update these terms, and continued website use after an update constitutes acceptance of the revised version.
